Terms & Conditions

1. Introduction

These Terms & Conditions (“Agreement”) govern your (“Customer”, “you”, “your”) use of the services provided by Washington Roofing (“Company”, “we”, “us”, “our”). By executing a Service Agreement, submitting an order, permitting us to perform work, or otherwise engaging our services, you agree to be bound by this Agreement. If you do not agree, you may not engage our services.

2. Services

2.1 We provide roofing services including roof installation, replacement, repair, inspections, maintenance, and related exterior services for residential and commercial properties.
2.2 The specific scope of services, deliverables, timing, pricing, and any special terms will be set forth in a separate written Service Agreement, work order, or quote signed or accepted by you.
2.3 Any additional or modified services beyond the signed scope must be confirmed in writing and may incur additional charges.

3. Customer Responsibilities

3.1 You must provide full, safe, and timely access to the property, including roof access, staging areas, and necessary permits or approvals (HOA, landlord, municipality).
3.2 You represent that you are the owner or authorized agent of the property, that work is lawful, and that no hazardous conditions (including structural instability, unsafe decking, mold, electrical hazards, or concealed damage) exist or will be addressed prior to work.
3.3 You agree to follow all safety instructions and post-project care guidelines.
3.4 You will notify us promptly if any issue, leak, or damage is observed.

4. Pricing, Payment & Cancellation

4.1 Pricing is set in your written quote or Service Agreement. Unless otherwise specified, payment is due upon completion of services and invoice issuance. Deposits may be required.
4.2 If services are scheduled but canceled within 48 hours of the scheduled start, a cancellation fee may apply.
4.3 Late payments may incur interest.
4.4 We reserve the right to suspend work, remove materials, or withhold warranties if payment is not received when due.

5. Changes to Services & Delays

5.1 We may adjust schedules due to weather, material availability, safety concerns, or site conditions.
5.2 If unforeseen conditions are discovered (such as rotted decking, structural damage, or code violations), additional work and costs may be required.
5.3 We are not liable for delays caused by factors beyond our control.

6. Warranties & Disclaimers

6.1 We warrant that our workmanship will meet industry standards.
6.2 Manufacturer warranties apply separately to materials where applicable.
6.3 We do not guarantee against all leaks or failures, especially where underlying structural issues or pre-existing conditions exist.
6.4 You assume responsibility for undisclosed conditions that impact performance or installation.

7. Limitation of Liability

7.1 Our total liability shall not exceed the amount paid for the specific service.
7.2 We are not liable for indirect, incidental, or consequential damages (including interior damage, loss of use, or business interruption).
7.3 Liability is limited to the maximum extent permitted by law.

8. Intellectual Property

8.1 All content, materials, and branding remain our property.
8.2 You may not reproduce or use our materials without written consent.

9. Permits, Codes & Compliance

9.1 You are responsible for permits and compliance unless otherwise specified.
9.2 We may stop work if unsafe or non-compliant conditions are identified.

10. Term and Termination

10.1 This Agreement remains in effect until completion of services.
10.2 Either party may terminate for material breach.
10.3 We may terminate immediately for non-payment or unsafe conditions.
10.4 You remain responsible for payment for work completed up to termination.

11. Materials, Debris & Site Conditions

11.1 Roofing involves debris removal; we will perform a standard cleanup, but small debris (e.g., nails) may remain despite reasonable efforts (magnetic sweeping used).
11.2 You are responsible for protecting personal property (vehicles, landscaping, valuables) near the work area.
11.3 Dump trailers, materials, and equipment may remain onsite during the project.

12. Safety & Insurance

12.1 We maintain general liability insurance.
12.2 You must maintain property insurance covering the structure.
12.3 You agree to report any issues or incidents promptly.

13. Force Majeure

We are not liable for delays due to events beyond our control, including weather, storms, or supply chain disruptions.

14. Amendments

We may update these Terms & Conditions at any time. Continued use of services constitutes acceptance.

15. Governing Law & Dispute Resolution

15.1 Governed by the laws of the State of Washington.
15.2 Disputes shall be resolved in King County, Washington through arbitration.
15.3 The prevailing party may recover reasonable legal fees.

16. Severability & Waiver

Invalid provisions do not affect the remainder of the Agreement.

17. Entire Agreement

This Agreement constitutes the entire agreement between the parties.
